Under Florida Statute Communications Between SCARS and the Crime Victims that we provide Services to are Privileged
To Clarify What Prviviledged Means
Privileged communication is defined as:
statements made by people within protected relationships (e.g., husband and wife, attorney and client) that the law shelters from forced disclosure on the witness stand.
Under Florida Statutes 90.5036 – as a crime victims’ advocate your communications are privileged in the same way as an attorney’s
As a professional crime victims’ advocate or assistance provider, there are 4 different kinds of communication between SCARS and the survivors we provide services to.
- PUBLIC – meaning it takes place in public or we have received permission to display it in public
- PRIVATE – these are communications that are shared between a SCARS Team member and an individual in confidence
- CONFIDENTIAL – these are communications that are meant to be confidential and not shared with the public, such as activity in our support groups or on a zoom call
- PRIVILEGED – means that it can take place in any non-public communication and cannot be accessed by government, law enforcement or a court. It means that SCARS Team members cannot be compelled to give evidence against a survivor that we provide services to.
However, any communications on a social media platform can be accessed with a warrant from a court.
This is just one of the many ethical considerations SCARS addresses on a daily basis.
